Assume for a moment that you have just been appointed to the Supreme Court. Congratulations! The first case you are going to hear is a case out of the state of North Carolina arguing that the death penalty is unconstitutional. The arguments being made in the case are identical to the arguments made in Furman v. Georgia. The Chief Justice has assigned you to write the majority opinion.
Your assignment is to write a legal opinion arguing to retain or abolish the death penalty. You should focus only on the holding and rationale for your holding. To do this you will need to work through and analyze each of these claims applying the appropriate legal tests and using the literature (previous cases, empirical literature, etc.) to support your position. Use the cases you have read in class for guidance.
The mechanics: I expect your brief will be around 5 pages double-spaced. This is not a hard and fast rule, just my expectation of what it will take to cover the two issues thoroughly. Treat each of the issues separately and feel free to use headings and subheadings liberally. Your response should include references – you may use any style of referencing that you are familiar with, but must be consistent in your use of that style.
