Julia Moscoso worked as a customer service representative in the billing department of Bamboo HR, Inc.
When questions arose about Moscoso’s performance on several occasions, department manager, Kathy Toney met with Moscoso to discuss, among other things, Moscoso’s personal use of a business phone. Toney reminded Moscoso that company policy prohibited excessive personal calls and that these would result in the termination of her employment. Toney began to monitor Moscoso’s phone usage, notine lengthy outgoing calls on several occasions, including some long-distance calls. Eventually, Toney terminated Moscoso’s employment, and Moscoso filed a suit in federal court against Bamboo HR. Moscoso asserted in part that in monitoring her phone calls, the employer had invaded her privacy. Bamboo HR asked the court to dismiss the claim. In whose favor should the court rule, and why?
