Overview
On January 6, 2021 President Trump gave a speech encouraging his supporters to march on the U.S. Capitol to protest his election defeat, which he called “take back the steal”. Test articulated by the Supreme Court in Brandenbury v. Ohio holding the first Amendment protects advocacy of illegal actions unless lawless action is intended and likely to occur.
