In Richard Rothstein’s The Color Of Law, the author analyzes how segregation in the United States was produced by local, state, and federal laws the actively promoted discriminatory patterns of housing that continue to this day. In this paper you will summarize, explore and explain various policies discussed by Rothstein. You will evaluate Rothstein’s argument that these policies constitute de jure segregation and discuss the contemporary outcomes of these historic processes.
There are four parts to this essay, please make sure you respond to all four parts.
First, define de facto and de jure Give an example of de facto segregation and describe how the process works.
Then, using evidence from chapters in The Color of Law, give two examples of de jure segregation that occurred at the federal level and one example of de jure segregation that occurred at local level. Since we discussed it so extensively in class please DO NOT use redlining as one of your examples.
Discuss the intent and outcome of each policy. What did the policy do and what was it intended to do? Make sure you explore various aspects of each process or policy that make it de jure segregation (i.e. reference back to your own definition of de jure segregation and show how this example meets your definition). Use evidence from the text to support your claim and cite evidence from a written policy, or public statement, or legal opinion (discussed by Rothstein) that further demonstrates that this form of segregation was de jure (and not de facto).
Finally, for each example of de jure segregation, describe a current outcome that still exists today.
A primary purpose of this essay is to practice using evidence to support claims. Your goal to provide evidence to back up the claims you make. Rothstein has made this easy since he has written a comprehensive review of segregation in the U.S. and given a complete history of these various laws and policies. Rothstein is the textual source you will be using to search out evidence. Use the evidence provided in the various chapters we have read. Make sure to provide page numbers to fully cite the text.
