Beginning your Contract 1 Analysis

I hope you have read the sections on Landlord Tenant Law. That is what this assignment is based on. It is not necessary to have read the chapters on Contracts.

Please focus on using the facts presented in the scenario with the law in the text. Remember to reference the text so I can find what you are relying on it I need to search.

Spelling and grammar are important. Many of you are in a four year university program or wish to transfer to one. Spelling and grammar are important. They are even more important in the “real world” of business. If you are a Paralegal Studies student, you already know about spelling and grammar. If you wish to start your own business, you may very well be dealing with clients who may judge you on how the business presents itself not only in its product but how is sells that product.

Below is a question for Contract 1. I am looking for the ability to read and comprehend the contract so the appropriate contract clause can be applied to the questions connected with each contract. In order to answer the contract fact scenario, you will also need to be able to identify the legal concept that is applicable to the situation described. This is an analysis so please treat it as such. Your personal opinion is not appropriate.

There are correct answers for the question. If a student discusses a different legal theory for answering the questions, partial points will be given. In cases of complete or partial answers, text references are mandatory to support the remedy proposed by the student. A text reference that has no bearing on the remedy or legal arguments will be counted as “no text”. For example, if any contract has an issue of risk of loss, referencing the text on contract formation will not meet the requirement. The sections of the text that you have read contain all the information you need for this analysis.

A student will be given 4 points for the text reference, 4 points for the contract reference, with 15 points for the analysis itself, 4 points for proper IRAC formatting.

Daniel, the landlord, refuses to sky light issue that was there prior to the current tenant. Raven, the current tenant, has just discovered the leakage issue from the sky light after a heavy rain. The consequence is that black mold has been forming on the attic for quite some time. Raven still has significant time remaining on her lease. Raven has notified Daniel in writing by email of the mold and leakage issue but has received no response. She is concerned about the premises becoming unsafe to live in. It has been 14 days since she emailed him her notification.

What are all of Raven’s options if Daniel declines to do the repairs?
